समाज में कानून व्यवस्था को सुचारू रूप से पालन कराने के लिए कुछ नियम कानून सरकार के माध्यम से बनाए गए हैं समाज में हो रहे व्यापक अत्याचार, कानून का दुरुपयोग रोकने के लिए न्यायालय का निर्माण किया गया है जिसमें वादी या प्रतिवादी के तरफ से मुकदमे की पैरवी करने के लिए अधिवक्ता की जरूरत होती है अधिवक्ता को वादी और प्रतिवादी के तरफ से उसे फीस प्राप्त होती हैं।
अधिवक्ता बनने के लिए योग्यता व नियम
अधिवक्ता बनने के लिए सर्वप्रथम 5 वर्षीय या 3 वर्षीय एलएलबी स्नातक होना अनिवार्य है आप किसी भी युनिवर्सिटी जो बार काउंसिल आफ इंडिया से एलएलबी की योग्यता के लिए डिग्री देने के लिए रजिस्टर्ड हो वहां से यह कोर्स कर सकते हैं कोर्स के उपरांत उपरांत आपको कॉलेज द्वारा डिग्री प्राप्त होता है| उसके बाद आप स्टेट बार काउंसिल में रजिस्ट्रेशन के लिए आवेदन कर सकते हैं |
स्टेट बार काउंसिल में रजिस्ट्रेशन के लिए निम्नलिखित प्रमाण पत्र की आवश्यकता होती हैं
1-हाई स्कूल प्रमाण पत्र
2- स्नातक मार्कशीट या प्रमाण पत्र
3- एलएलबी मार्कशीट या प्रमाण पत्र
4- डिग्री या प्रोविजनल डिग्री
5- ब्लैक कोट टाई में 5 फोटो
6- नोटरी एफिडेविट
7- स्टेट बार काउंसिल की रजिस्ट्रेशन फीस ( डी डी ) में
नोट- स्टेट बार काउंसिल की फीस भिन्न भिन्न राज्यों में अलग हो सकती हैं।
यहां सभी ओरिजिनल प्रमाण पत्र आवेदन पत्र के साथ संलग्न करके जमा करने के बाद कुछ दिनों में आपको रजिस्ट्रेशन नंबर ,आईडी कार्ड पत्र प्राप्त कर सकते हैं तत्पश्चात आपको बार काउंसिल ऑफ इंडिया का एग्जाम पास करना होता है बार काउंसिल ऑफ इंडिया का एग्जाम पास करने के बाद बीसीआई का सर्टिफिकेट प्राप्त होता है | उसके उपरांत आप सी ओ पी ( सर्टिफिकेट आफ प्रैक्टिस ) के फॉर्म को आवेदन कर सकते हैं तब आपको सी ओ पी नंबर प्राप्त होता है उसके बाद आप किसी भी सीनियर अधिवक्ता के साथ अपनी प्रैक्टिस की शुरुआत कर सकते हैं।
